By accessing or using the MaxelTracker platform, including its website, desktop application, mobile application, and web interface (collectively, the "Product"), you agree to comply with and be bound by the following terms and conditions ("Terms of Service" or "Terms"). These Terms are a legal agreement between you ("You," the "Workspace Owner," or "Workspace Member") and MaxelTracker Inc. ("We," "Us," "Our," or the "Company"). Please read these Terms carefully before subscribing to or using the Product. If you do not agree with any of the provisions contained herein, you must refrain from using the Product.
For the purposes of these Terms, the following definitions apply:
"We," "Us," "Our" refer to MaxelTracker Inc., its affiliates, employees, officers, agents, and assigns. These entities provide access to the Product, which is designed for use by employers, employees, and freelancers.
"Website" refers to the official website of MaxelTracker, [https://maxeltracker.com/]
"Product" refers to the suite of applications provided by MaxelTracker, including the web application, and mobile app. The Product allows employers to monitor the digital activities of their employees or freelancers and provides tools to enhance personal productivity.
"Workspace Owner" refers to the individual who creates and manages a workspace within the Product. This person invites and manages Workspace Members and has administrative control over the workspace. A Workspace Owner may also be an employee or freelancer who wishes to track their performance independently.
"Workspace Member" An individual invited by a Workspace Owner to join the workspace and whose digital activity may be monitored as part of the workspace's productivity and performance tracking.
"You" refers collectively to both Workspace Owners and Workspace Members who use the Product.
You are welcome to browse the Website without creating an account. However, in order to use the Product, you must first register by creating an account.
To register, you must provide the following information:
Your first name and last name
A valid email address
A secure password
By registering, you agree to be bound by these Terms. You are responsible for maintaining the confidentiality of your login details, including your password. Any activity that occurs under your account, whether by you or someone else, is your responsibility. If you believe your account has been compromised or accessed without your authorization, you should notify us immediately.
Upon registration, you will receive an email with a verification link. A link is sent to the email address on signing up. You must verify it if you wish to continue using the Product after the trial expires.
By using the Website and the Product, you consent to the collection, storage, and processing of your personal data in accordance with our “Privacy Policy”. You must provide accurate, complete, and up-to-date information during registration, as we are not responsible for any issues or damages that may arise due to incorrect or outdated information. We do not verify the accuracy of the information you provide nor do we use the data collected for our own benefit.
The use of the Product is free of charge during the trial period of 14 days, which is outlined on the Website. Once the trial period ends, Workspace Owners will be required to subscribe to a paid plan to continue using the Product.
Subscription Fees: Fees are calculated based on the number of Workspace Members and the subscription plan selected (monthly or yearly). Payments are processed electronically by third-party payment service providers. In case of a conflict, you can reach out to payment providers as well. MaxelTracker does not store your payment details and is not responsible for any issues related to payment processing. You may request the privacy policies of these payment providers at any time.
Billing Cycle: The subscription begins immediately after the trial period ends and is billed on a recurring monthly or yearly basis, depending on the chosen plan. You may change your subscription plan (upgrade, downgrade, or cancel) at any time. Any changes will take effect at the start of the next billing cycle unless otherwise agreed.
Non-Payment: Failure to pay for your subscription by the due date may result in suspension or termination of your account and access to the Product. If payment is not received according to the agreed-upon schedule, your subscription will be considered canceled.
No Refund for Unused Period: Once you purchase a monthly or yearly subscription, we do not offer refunds for any unused periods. However, you may request a refund under the following conditions:
Monthly Subscription: Refunds may be requested within 15 days of payment. Yearly Subscription: Refunds may be requested within 30 days of payment.
The Product is provided to you for lawful, personal, or business use only. You must not use the Product in a way that could:
Damage, disable, or impair the Product’s functionality.
Introduce viruses, malware, or malicious software into the Product.
Engage in unauthorized data collection, scraping, or mining activities.
Engage in activities that violate applicable laws or infringe on the rights of others.
You may only use the Product in accordance with its intended purposes and features, as described on the Website and in any user documentation. Any misuse of the Product may result in account suspension or termination.
We reserve the right to suspend or terminate your account if you violate any provision of these Terms, engage in illegal activities, or fail to make timely payments.
Workspace Members: Your account may be suspended if you violate the law or breach these Terms. Suspension may also occur based on complaints or violate workplace policies set by the Workspace Owner.
Workspace Owners: Your account may be suspended for the same reasons as for Workspace Members. Additionally, failure to make payments may result in suspension or termination of your account.
If your account is suspended or terminated, you will not be able to access the Product. We are not liable for any damages that may result from the suspension or termination of your account but you can reach out to us for resolution.
Workspace Owners: You can delete your account at any time. Account deletion will permanently disable your access to the Product, including all workspaces associated with your account.
Workspace Members: If a Workspace Owner deletes their account, the Workspace Members' accounts will also be deleted, unless the Member is part of other workspaces.
Once deleted, your data will be removed from our servers, and you will no longer be able to use the Product with the same login credentials.
The Product may contain links to third-party websites or applications. MaxelTracker does not control or assume responsibility for the content, privacy policies, or practices of these third-party sites. You access these sites at your own risk. We recommend reading the privacy policies and terms of use of any third-party websites you visit.
All content provided through the Product, including text, images, videos, graphics, logos, and software, is the intellectual property of MaxelTracker Inc. or its licensors. You may not modify, distribute, or reproduce any of this content without prior written consent from MaxelTracker.
Trademarks and service marks used in the Product are the property of MaxelTracker and are protected by applicable law.
The Product is provided "as is" and "as available," without any warranties of any kind, whether express or implied. MaxelTracker does not guarantee the accuracy, availability, or fitness of the Product for any specific purpose.
We are not liable for any damages or losses resulting from your use of the Product, including but not limited to:
Loss of data
Business interruption
System failures
Third-party actions, such as viruses or malware
We are not responsible for any downtime caused by maintenance, unforeseen technical issues, or external factors beyond our control, such as internet failures or third-party service disruptions. While we strive to ensure uninterrupted service, we cannot guarantee continuous availability of the Product.
Any disputes between you and MaxelTracker shall be resolved through direct negotiations. If negotiations fail within 30 days, the dispute will be submitted to the exclusive jurisdiction of the (courts in California, USA, in accordance with California law). Upon mutual agreement, disputes may be submitted to mediation or arbitration.
MaxelTracker reserves the right to modify or update these Terms at any time. All changes will be posted on the Website and will take effect immediately upon posting. Continued use of the Product after the changes have been posted signifies your acceptance of the modified Terms.
